Early Years providers are obliged to comply with a large amount of employment and health and safety legislation. The Early Years sector is also required to be compliant with Regulation 9 (Management and Recruitment) and 11 (Staffing Levels) of the Child Care Act 1991 (Early Years Services Regulations) 2016 adding to what can be a heavy burden in terms of HR policies and staff records. Under Employment Law you must have the following in place at a minimum

  • Anti-Bullying and Harassment
  • Equality Statement
You are also required to have a large number of employment records and these are open to inspection.

Under the Child Care Act 1991 (Early Years Service Regulations 2016) you must have the following in place

  • Recruitment & Selection Policy
  • Absence Cover Policy
  • Garda Vetting Policy
  • Training & Qualifications Policy
  • Student and Volunteer Placement Policy
  • An Induction System
  • A System for Supervising and Supporting Staff
  • Clear outline of Governance Structure and Roles & Responsibilities
  • Up to date Staff Records to include the following list of mandatory items:
    1. Staff Information Sheet
    2. CV and completed Application Form
    3. Job Description
    4. Proof of Identity (passport, drivers license)
    5. Two References (validated)
    6. Processed Garda Vetting Form
    7. Processed International Police Check (certified and translated)
    8. Training Record
    9. Induction Sheet
    10. Copies of Qualifications and Training Certificates (certified)
    11. Contract of Employment
    12. Supervision Records
    13. Policy Sign-off
You are also required to have a records that are under inspection by the preschool Inspection Team.
